For detailed information on the subject of data protection, please refer to our data protection declaration listed below this text.

Data collection on our website

Who is responsible for data collection on this website?

The data processing on this website is carried out by the website operator. Their contact data can be found in the imprint of this website.

How do we collect your data?

On the one hand, your data is collected by you communicating it to us. This may involve data that you enter in a contact form, for example.

Other data is automatically collected by our IT systems when you visit the website. These are mainly technical data (e.g. Internet browser, operating system or time of the page call). This data is collected automatically as soon as you enter our website.

What do we use your data for?

Part of the data is collected to ensure that the website is error-free. Other data can be used to analyse your user behaviour.

What rights do you have with regard to your data?

You have the right at any time and free of charge to obtain information about the origin, recipient and purpose of your stored personal data. You also have the right to request that this data be corrected, blocked or deleted. You can contact us at any time at the address given in the imprint for this as well as for further questions on the subject of data protection. Furthermore, you have the right to appeal to the responsible supervisory authority.

In addition, you have the right, under certain circumstances, to demand the restriction of the processing of your personal data. For details please refer to the data protection declaration under "Right to limitation of processing".

Analysis tools and third-party tools

When you visit our website, your surfing behaviour can be statistically evaluated. This is done primarily with cookies and so-called analysis programs. The analysis of your surfing behaviour is usually anonymous; the surfing behaviour cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. Detailed information on this can be found in the following privacy statement.

You can object to this analysis. We will inform you about the possibilities of objection in this data protection declaration.

2. general information and mandatory information

data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and according to the legal data protection regulations as well as this data protection explanation.

If you use this website, various personal data will be collected. Personal data is data with which you can be personally identified. This Privacy Policy explains what information we collect and how we use it. It also explains how and for what purpose this is done.

We would like to point out that data transmission over the Internet (e.g. communication by e-mail) can be subject to security gaps. A complete protection of the data against access by third parties is not possible.

Reference to the responsible office

The responsible body for data processing on this website is:

ESL E-MOBILITY GmbH

Technologie Park 13

D-33100 Paderborn, Germany

Phone: +49 (0) 5251-14 20 923

E-mail: info@esl-emobility.com

The responsible body is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, e-mail addresses, etc.).

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke your consent at any time. For this purpose, an informal e-mail notification to us is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right of objection against data collection in special cases and against direct advertising (Art. 21 DSGVO)

If data processing is carried out on the basis of Art. 6 para. 1 lit. e or f DSGVO, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which a processing is based can be found in this data protection declaration. If you file an objection, we will no longer process your personal data concerned unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal claims (objection according to Art. 21 para. 1 DSGVO).

If your personal data are processed for the purpose of direct advertising, you have the right to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is connected with such direct advertising. If you object, your personal data will no longer be used for direct marketing purposes (objection according to Art. 21 para. 2 DSGVO).

Right of appeal to the competent supervisory authority

In the event of infringements of the DSGVO, the persons concerned have the right to appeal to a supervisory authority, in particular in the Member State of their habitual residence, workplace or place of presumed infringement. The right of appeal shall be without prejudice to other administrative or judicial remedies.

Right to data transferability

You have the right to have data which we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible person, this will only be done as far as it is technically feasible.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after the conclusion of a contract with costs, there is an obligation to provide us with your payment data (e.g. account number for direct debit authorization), this data is required for payment processing.

Payment transactions via the usual means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

With encrypted communication, your payment data, which you transmit to us, cannot be read by third parties.

Information, blocking, deletion and correction

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, their origin and recipient and the purpose of data processing and, if applicable, a right to correction, blocking or deletion of this data. You can contact us at any time at the address given in the imprint for this and other questions on the subject of personal data.

Right to limitation of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time at the address given in the imprint. The right to restriction of the processing exists in the following cases:

If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. For the duration of the examination you have the right to demand the restriction of the processing of your personal data.
If the processing of your personal data has taken place unlawfully, you can demand the restriction of data processing instead of deletion.
If we no longer need your personal data, but you need it for the exercise, defence or assertion of legal claims, you have the right to demand the restriction of the processing of your personal data instead of deletion.
If you have lodged an objection pursuant to Art. 21 Para. 1 DSGVO, a balance must be struck between your and our interests. As long as it is not yet clear whose interests predominate, you have the right to demand that the processing of your personal data be restricted.
If you have restricted the processing of your personal data, these data may only be processed - apart from their storage - with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

Opposition to promotional e-mails

We hereby object to the use of contact data published within the scope of the imprint obligation to send unsolicited advertising and information material. The operators of this website expressly reserve the right to take legal action against unsolicited mailing or e-mailing of spam and other similar advertising materials.

3. data collection on our website

cookies

Some of the Internet pages use so-called cookies. Cookies do not damage your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, more effective and safer. Cookies are small text files that are stored on your computer by your browser.

Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your terminal until you delete them. These cookies enable us to recognize your browser during your next visit.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, accept cookies for certain cases or generally exclude them and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

Cookies which are necessary for the electronic communication process or for the provision of certain functions requested by you (e.g. shopping basket function) are stored on the basis of Art. 6 para. 1 lit. f DSGVO. The website operator has a justified interest in the storage of cookies for the technically error-free and optimised provision of its services. Insofar as other cookies (e.g. cookies for analysing your surfing behaviour) are stored, these are dealt with separately in this data protection declaration.

Server log files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

Browser type and browser version
used operating system
Referrer URL
Hostname of the accessing computer
Time of the server request
IP address
This data will not be merged with other data sources.

This data is collected on the basis of Art. 6 para. 1 lit. f DSGVO. The website operator has a justified interest in the technically error-free presentation and optimisation of his website - for this purpose the server log files must be recorded.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form including the contact data you provided there will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. These data will not be passed on without your consent. The processing of the data entered in the contact form is therefore carried out exclusively to answer your enquiry.

The legal basis for the processing of the data is Art. 6 para. 1 lit. a DSGVO if the user has given his consent. As far as the establishment of contact is aimed at the conclusion of a contract, the legal basis is additionally based on Art. 6 para. 1 lit. b DSGVO. In all other cases or in addition to the above applicable legal bases, the legal basis for data processing is based on Art. 6 para. 1 lit. f DSGVO, our legitimate interest to respond to your inquiry and to contact you for this purpose. You can revoke this storage of your inquiry at any time. For this purpose, an informal e-mail notification to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data entered by you in the contact form will remain with us until you request deletion, revoke storage or the purpose for data storage no longer applies (e.g. after final processing of your request). Mandatory legal provisions - in particular retention periods - remain unaffected.

Inquiry by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request including all personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6 Para. 1 lit. b DSGVO if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on your consent (Art. 6 para. 1 lit. a DSGVO) and / or on our legitimate interests (Art. 6 para. 1 lit. f DSGVO), as we have a legitimate interest in the effective processing of enquiries addressed to us.

The data you send us via contact requests will remain with us until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Registration on this website

You can register on our website to use additional features on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise we will refuse the registration.

In the case of important changes, for example in the scope of our services or in the case of technically necessary changes, we will use the e-mail address provided during registration to inform you in this way.

The data entered during registration will be processed on the basis of your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent at any time. An informal e-mail notification to us is sufficient for this purpose. The legality of the data processing already carried out remains unaffected by the revocation. The data collected during registration will be stored by us as long as you are registered on our website and will subsequently be deleted. Legal retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures. We collect, process and use personal data relating to the use of our Internet pages (usage data) only to the extent necessary to enable the user to make use of the service or to bill the user.

The collected customer data will be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.

Data transmission at contract conclusion for online shops, dealers and dispatch of goods

We transmit personal data to third parties only if this is necessary in the context of contract processing, for example to the companies entrusted with the delivery of the goods or the credit institution entrusted with payment processing. A further transmission of the data does not take place or only if you have expressly agreed to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

4. analysis tools and advertising

Google Analytics

This website uses functions of the web analysis service Google Analytics. Provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States.

The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

IP anonymisation

We have activated the IP anonymization function on this website. This will cause Google to shorten your IP address within European Union member states or other signatory states to the Agreement on the European Economic Area prior to transmission. Only in exceptional cases will the full IP address be transmitted to a Google server and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other data from Google.

Browser Plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. In addition, you can prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and Google from processing this data by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Objection to data collection

You can prevent Google Analytics from collecting your data by clicking on the following link. An opt-out cookie is set to prevent your information from being collected on future visits to this website: Disable Google Analytics.

For more information on how Google Analytics uses user data, please refer to Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.

Order processing

We have concluded a contract with Google for order processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic characteristics of Google Analytics

This website uses the function "demographic features" of Google Analytics. This allows reports to be generated that contain information about the age, gender and interests of site visitors. This data comes from interest-related advertising by Google and visitor data from third parties. This information cannot be associated with any specific individual. You can deactivate this function at any time via the ad settings in your Google Account or generally prohibit Google Analytics from collecting your data as described under "Objection to data collection".

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

Within the framework of Google AdWords, we use so-called conversion tracking. When you click on an ad placed by Google, a conversion tracking cookie is set. Cookies are small text files that the Internet browser places on the user's computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not expired, Google and we may recognize that the user clicked on the ad and was directed to that page.

Each Google AdWords customer receives a different cookie. Cookies cannot be tracked through AdWords customer websites. The information collected from the Conversion cookie is used to generate conversion statistics for AdWords customers who have opted for Conversion Tracking. Customers will know the total number of users who clicked on their ad and were directed to a page with a conversion tracking tag. However, they will not receive information that personally identifies users. If you do not wish to participate in tracking, you can opt out of this use by easily turning off the Google Conversion Tracking cookie in your Internet browser under User Preferences. You will then not be included in the conversion tracking statistics.

The storage of "conversion cookies" and the use of this tracking tool are based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

More information about Google AdWords and Google Conversion Tracking can be found in Google's privacy policy: https://policies.google.com/privacy?hl=en.

You can set your browser to notify you when cookies are set, to permit cookies only in individual cases, to refuse or to accept cookies in certain cases, and to enable automatic deletion of cookies when you close your browser. If cookies are deactivated, the functionality of this website may be restricted.

Integration of the Google Tag Manager

This website uses the functions of the Google Tag Manager. Provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The Google Tag Manager is a solution that allows marketers to manage website tags through a single interface. This tool works without cookies, but requires the transmission of IP addresses to Google. The legal basis for data processing is Art. 6 Para. 1 S. 1 f) DSGVO. Further information and the data protection regulations can be found in the data protection declaration of the Google Tag Manager at: https://www.google.de/tagmanager/use-policy.html.

Order processing

We have concluded a contract with Google for order processing and fully implement the strict requirements of the German data protection authorities when using the Google Tag Manager.

Facebook Pixel

Our website uses the visitor action pixel of Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") to measure conversion.

This allows us to track the behavior of site visitors after they are redirected to the provider's Web site by clicking on a Facebook ad. This allows the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and to optimize future advertising efforts.

The data collected is anonymous to us as the operator of this website and we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Guidelines (https://de-de.facebook.com/about/privacy/). As a result, Facebook may allow advertisements to be placed on Facebook pages and outside Facebook. This use of data cannot be influenced by us as the site operator.

The use of Facebook pixels is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a justified interest in effective advertising measures, including social media.

You will find further information on the protection of your privacy in the Facebook data protection information: https://de-de.facebook.com/about/privacy/.

You can also deactivate the remarketing function "Custom Audiences" in the Settings for Advertisements section at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do this.

If you do not have a Facebook account, you can disable Facebook's usage-based advertising on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/de/praferenzmanagement/.

5. Newsletter

newsletter data

If you wish to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data will not be collected or will only be collected on a voluntary basis. We use these data exclusively for the dispatch of the requested information and do not pass these on to third parties.

You can revoke your consent to the storage of data, e-mail address and their use to send the newsletter at any time, for example via the "Unsubscribe" link in the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

The data you have stored with us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel the newsletter. Data stored by us for other purposes remain unaffected by this.

6. plugins and tools

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on our websites. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

The purpose of reCAPTCHA is to check whether the data input on our websites (e.g. in a contact form) is made by a person or by an automated program. To this end, reCAPTCHA analyses the behaviour of the website visitor on the basis of various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, length of stay of the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

Data processing is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in protecting his web offers against abusive automated spying and against SPAM.

Further information on Google reCAPTCHA and Google's privacy policy can be found on the following links: https://policies.google.com/privacy?hl=en and https://www.google.com/recaptcha/intro/android.html.

7. payment providers and resellers

PayPal

On our website we offer payment via PayPal. The provider of this payment service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal").

Only in the case of outstanding receivables do we reserve the right, after prior notification, to involve a collection service provider or legal remedy, in which case first name, surname, full address as well as e-mail and telephone number and outstanding receivable amount will also be transmitted to the body specified in advance for this purpose.

You have the option of withdrawing your consent to the SEPA Direct Debit Mandate at any time. Please note, however, that this has no effect on the contractual obligations, i.e. services of the contract must continue to be paid.
