Cancellation terms
(1) Cancellation policy for goods
a) Right of Withdrawal: You have the right to withdraw from this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods. To exercise your right of withdrawal, you must contact us: ESL E-Mobility, Technology Park 13, 33100 Paderborn, Mail: info@esl-emobility.com, FAX: +49 5251 1420925 by means of a clear statement (eg a mailed by post Letter, fax or e-mail) about your decision to withdraw from this contract. You can use the enclosed model withdrawal form (see above), which is not required. In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
b) Consequences of the cancellation: If you withdraw from this contract, we must repay all payments we have received from you without delay and at the latest within fourteen days from the date on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days.
You have to bear the direct costs of returning the goods (§ 357 (6) BGB). For non-parceled goods that have been previously delivered by forwarding agency, please ask us in advance the amount of shipping costs and then send them back to our risk.
For a deterioration caused by the intended use of the thing, you do not have to pay any compensation. You only have to pay compensation for drawn benefits if you have used the goods in a manner that goes beyond checking the properties and functioning. The term "testing the properties and the mode of operation" means testing and trying out the respective goods, as is possible and customary in a shop, for example.
Exclusion of the right of withdrawal
The right of revocation does not exist for contracts for the supply of goods, which are manufactured according to customer specification or are clearly tailored to the personal needs or which by their nature are not suitable for a return or spoil quickly or whose expiration date would be exceeded, for the delivery of audio - or video recordings or software, provided that the delivered data carriers have been unsealed by you or for the delivery of newspapers, magazines and magazines, unless you have given their contract explanation by phone
